These Terms explain how you may use the Mummy MOT® website at https://themummymot.com (the “Site”). Please read them carefully before using the Site.

By accessing or using the Site, you agree to be bound by these Terms and the documents referred to in them. If you do not agree, please stop using the Site.

2. Definitions

Content means any text, images, video, audio or other material on the Site.
Submission means any material submitted to the Site by you or other users.
Terms means these terms of use, as updated from time to time under section 12.
Acceptable Use Policy means the policy set out in section 8.
Privacy Policy means our policy at https://themummymot.com/privacy-policy/, which governs how we handle personal data.
Cookie Policy means our policy at https://themummymot.com/cookie-policy/, which governs how we use cookies.
You or your means the person accessing or using the Site or its Content.

Your use of the Site means you also agree to our Privacy Policy, our Cookie Policy and the Acceptable Use Policy below. Where you buy courses, memberships, programmes or products through or via the Site, separate terms and conditions of sale will apply to that purchase.

3. Using the Site

The Site is for your personal, non-commercial use only, except where we agree otherwise in writing.
You are responsible for any costs you incur in accessing the Site, including data and equipment.
We try to make the Site as accessible as possible. If you have any difficulty using it, please contact us at help@mummymot.com.
We may suspend or withdraw your access to the Site if you do not comply with these Terms, any policy referred to in them, or any applicable law.

4. The information on the Site is not medical advice

The Content on the Site — including our resources, condition information and self-help material — is provided for general information only. It is not medical, clinical, financial or legal advice, and you should not rely on it as a substitute for professional advice.

A Mummy MOT® assessment or treatment is delivered by an independently accredited practitioner or at Mummy MOT HQ. If you have a health concern, please seek advice from a suitably qualified healthcare professional. In an emergency, contact the emergency services or your GP.

5. Our practitioners

Many Mummy MOT® assessments are delivered by independently accredited practitioners who run their own clinics under their own trade names. Those practitioners are independent of us. When you book or receive an assessment from a practitioner, your contract for that service is with that practitioner, not with Mummy MOT Ltd, and the practitioner is responsible for the care they provide and for the personal and health data they collect from you.

We provide training and accreditation and maintain the practitioner directory. We are not responsible for the acts or omissions of individual practitioners.

6. Ownership and intellectual property

This Site and all intellectual property rights in it, including all Content, are owned by us or our licensors. This includes copyright, trademarks, trade names, logos, design rights, database rights and all other intellectual property rights, whether registered or unregistered, anywhere in the world.

We reserve all our rights. Nothing in these Terms grants you any rights in the Site other than those needed to access and use it as permitted here. You may not use our trademarks, trade names or logos except in accordance with these Terms or with our prior written permission.

7. Submitting information to the Site

While we try to keep the Site secure, we cannot guarantee the security of any information you send to us through it, and cannot guarantee it will be kept confidential. Please do not submit anything through the Site that you regard as confidential, commercially sensitive or valuable.

Where you make a Submission, you grant us a non-exclusive, royalty-free right to use it as reasonably necessary in connection with the Site. We are not responsible to you or anyone else for any use of Submissions made in line with these Terms.

8. Acceptable Use Policy

As a condition of using the Site, you agree not to:

use the Site for any unlawful purpose or in breach of these Terms;
use the Site to commit fraud;
distribute viruses, malware or other harmful code;
send unsolicited advertising or spam;
impersonate us or any other person, or attempt to obtain identity information or credentials (“phishing”);
disrupt the operation of the Site or of any other person’s website or business;
use the Site in any way that harms minors;
promote any unlawful activity;
represent or suggest that we endorse any business, product or service unless we have agreed this in writing;
gain or attempt to gain unauthorised access to any computers, data, systems, accounts or networks; or
attempt to circumvent any password or authentication measures.

Interactive areas. Where we provide interactive features (for example comments), we are not obliged to monitor or moderate them, but we may remove or edit any Submission at our discretion. Any Submission must be your own lawful work, accurate or genuinely held, properly consented to where it involves a third party, and must not be defamatory, offensive, obscene, sexually explicit, discriminatory, deceptive or otherwise objectionable.

Linking to the Site. You may link to the Site provided the link does not: frame or surround the Site’s content; imply that we endorse you or your products or services; display our trademarks or logos without permission; or sit on a site that does not meet this Acceptable Use Policy. We may ask you to remove any link at any time, and you must comply promptly.

Breach. We apply these Terms at our reasonable discretion. If you breach them, we may suspend or end your access to the Site, remove or edit Submissions, disclose material to law enforcement, or take any other action we consider appropriate.

9. Accuracy and availability of the Site

While we try to keep the Site accurate, up to date and free from faults, we cannot promise that it will be, or that it will be suitable for any particular purpose. Any reliance you place on the Content is at your own risk.

We do not promise that the Site will always be available or uninterrupted, and we may suspend, withdraw or change all or part of it at any time.

10. Third-party sites

The Site may contain links to websites operated by others. We provide these for convenience only, have no control over them, and accept no responsibility for their content. A link does not mean we endorse the linked site. Your use of a third-party site is governed by that site’s own terms.

11. Our liability

We do not exclude or limit our liability to you where it would be unlawful to do so, including any liability for death or personal injury caused by our negligence, or for fraud.

Subject to that, we are not responsible for any losses that were not foreseeable to you and us when these Terms were formed, that were not caused by a breach on our part, or that are business losses (such as loss of profit, business, contracts or opportunity).

12. Changes to these Terms

No change to these Terms is valid unless we make it. We may update these Terms from time to time. The current version will always appear on this page. By continuing to use the Site after we post a change, you accept the updated Terms. Please check this page from time to time.

13. Governing law and jurisdiction

These Terms, and any dispute arising out of or in connection with them, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
